Zoning Bylaw Update

Zoning Bylaw 1380 (Update)

The Town of Oliver is currently updating its zoning bylaw to improve consistency with the new Official Community Plan (OCP) Bylaw 1370 that was adopted by Council on March 13, 2017.

  • re-ordering bylaw sections to correspond to the sections of the OCP Bylaw;
  • creation of a new “Town Centre (TC) Zone” to be applied to lands designated “Town Centre under the OCP Bylaw;
  • introduction of “assembly”, “child care centre, major”, “museum” and “apartment building” as permitted uses in the TC Zone;
  • allowance for ground floor residential uses in the TC Zone on parcels not fronting Main Street;
  • removal of “gravel crushing” as a permitted use in the General Industrial (M1) Zone;
  • introduction of an Airport (AP) Zone to be applied to the airport lands;
  • re-classifying the Residential Assisted Living (RAL) Zone as an institutional zone as opposed to high density residential zone;
  • re-naming the “Commercial Transition” Zone to “General Commercial”;
  • creating a 75.0 metre setback in the AG Zone from Tuc-el-nuit Lake to preserve lands so zoned for future parkland acquisition; and
  • identifying a number of properties whose current use is legally non-conforming (i.e. not permitted by current zoning) and contacting affected property owners about options to address this situation.

The update of the Zoning Bylaw will also allow for the consolidation of the approximately 26 amendments that have been made to the current Zoning Bylaw 1350 since its adoption in 2014.
